DECREE NR.
1538, OF JUNE 27th, 1995.

Establishes the Executive
Group for Repression Against Forced Labor and sets
forth other provisions. |
THE PRESIDENT OF THE REPUBLIC
, in the use of the attributions granted to him by art.
84, numeral VI, of the Constitution,
ENACTS:
Art. 1º The establishment of the Executive
Group for Repression Against Forced Labor (Grupo Executivo
de Repressão ao Trabalho Forçado - Gertraf),
with the purpose of coordinating and implementing the
necessary provisions for the repression to forced labor.
Art. 2º It is the competence
of Gertraf:
I - to prepare, implement and supervise an integrated
program for the repression to forced labor;
II - to coordinate the action of
the competent bodies for the repression to forced labor,
nominating the measures applicable;
III - to articulate with the International
Labor Organization - ILO and with the Federal and State
Departments of Justice (Ministérios Públicos),
aiming at the exact compliance of the pertinent legislation;
IV - to propose the statutory acts
that are required for the implementation of the Program
foreseen under numeral I.
Art. 3º Gertraf shall
be subordinated to the Chamber of Social Policies of
the Government Council and shall be made up by one representative
from the following Ministries:
I - of Labor;
II - of Justice;
III - of Environment, Water Resources
and the Legal Amazon;
IV - of Agriculture, Supply and
Land Reform;
V - of Industry, Trade and Tourism.
§ 1º Representatives
from other public or private bodies or entities may
be invited to take part in the work carried out by Gertraf.
§ 2º The members of Gertraf
and their corresponding deputies shall be designated
by the Minister of State of Labor, by means of nomination
by the Ministers of State to which they are subordinated,
§ 3º The Ministry of
Labor shall provide technical and administrative support
to the work of Gertraf, its representative being responsible
for coordinating the activities of the Executive Group.
§ 4º Participation in
Gertraf shall be considered relevant public service,
without any additional remuneration.
Art. 4º Gertraf, within
thirty days, counted from the day it is established,
shall prepare and submit the statute that disciplines
its functioning to the approval of the Minister of State
of Labor.
Art. 5º This decree
enters into force on the date of its publication.
Art. 6º
The Decree of September 3rd, 1992, which institutes
the Program for the Eradication of Forced Labor and
of Attraction of Laborers (Programa de Erradicação
do Trabalho Forçado e do Aliciamento de Trabalhadores
- Perfor) is revoked hereby.
